What is Trademark Class 32?

Trademark Class 32 encompasses beverages, including non-alcoholic drinks and beer. This class is crucial for businesses producing and distributing beverages for various markets.

Examples include soda manufacturers, breweries, and producers of fruit juices or flavored waters.

Class 32 ensures proper trademark classification for a diverse range of beverage products.

What are key features of Class 32?

Key features include the production, branding, and marketing of non-alcoholic beverages and beers.

Class 32 for trademarks: a brief description

Class 32 covers beverages, both alcoholic (limited to beer) and non-alcoholic, such as sodas, fruit juices, and mineral waters. It also includes preparations for making beverages like syrups and powders.

Businesses in this category serve diverse consumer needs, from casual refreshments to health-focused drinks.

Practical examples of Class 32

Examples include craft breweries, energy drink producers, and companies manufacturing soda concentrates.

What Does Class 32 Include?

Class 32 includes the immense variety of categories that range in each of the tastes and diets, starting from refreshing drinks through functional beverages and including a series of indispensable ingredients to create those and many other beverage categories.

Main products within this class:

It covers de-alcoholized beverages, which are drinks subjected to a procedure that removes the alcohol from them while retaining their flavors. It also includes soft drinks, covering everything from carbonated sodas to flavored non-alcoholic beverages.

It also encompasses vegetable beverages, rice-based and soy-based drinks, in Class 32, inasmuch as these beverages are not milk substitutes. This qualification, at this point, will keep these products from being classified as milk alternatives. Mineral or purifying water or other functional beverages like energy, isotonic, and protein-enriched sports drinks, also fall under this category since they are aimed at improving hydration, performance, or recovery.

This class also includes non-alcoholic essences and fruit extracts used in the preparation of beverages. Such ingredients function as flavor enhancers and bases for drinks. Class 32 covers the right classification for products in the refreshment and health-concentrated drink industry for a wide range of non-alcoholic beverages and drink ingredients.

Trademark Class 32 does not include

While Class 32 covers a vast area of non-alcoholic beverages, some drinks and ingredients are explicitly excluded and classified under various trademark classes. This exclusion creates the difference between ordinary non-alcoholic beverages and those for medical, culinary, or special purposes.

For example, beverage flavorings that are essential oils fall under Class 3 while other flavorings for beverages fall under Class 30. All dietetic beverages adapted for medical purposes will fall under Class 5 since its application is for treatment rather than consumption by the general public. Similarly, milk beverages, such as milkshakes and drinks where the primary ingredient is milk, are classified under Class 29, as are milk alternatives like almond milk, coconut milk, peanut milk, rice milk, and soy milk.

Other Exclusions

Juices that are consumed in cooking or used as an ingredient, like lemon juice used in cooking and tomato juice used as an ingredient in the preparation of other foods, are also not classified under Class 32 but under Class 29. Coffee-, cocoa-, chocolate-, and tea-based drinks are classified under Class 30 since these could not be classified under the heading of soft drinks or fruit drinks. Similarly, pet beverages are classified under Class 31 and alcoholic beverages, excluding beer, under Class 33.

These exclusions are important in ensuring proper classification of products, hence giving businesses a proper way of registering their trademarks while observing international classification standards.
