What Does Class 31 Include?

Class 31 is a very diverse class of unprocessed agricultural, horticultural, and forestry products, as well as some natural products for consumption, cultivation, or use by animals. The goods in this class are mostly raw materials that have not been substantially processed.

This class includes raw cereals, which are utilized for foodstuffs, animal feeding, and agriculture. It also encompasses fresh fruits and vegetables, even when subjected to primary processing, such as washing or waxing, if the same products remain in their natural state. Other products in Class 31 are unsawn timber, further classified for use in building, carpentry, and joinery, and for furniture making. It also involves fertilized eggs for hatching, as these come under the category of poultry raising and breeding. Fresh mushrooms and truffles are also classified under this class due to their value both in the culinary field and commercially.

Trademark Class 31 does not include

While Class 31 includes such a broad spectrum of unprocessed agriculture and natural products, some of the items excluded are specifically reserved for other classes of trademarks. The exclusion mainly occurs with regard to those goods which are used medicinally, industrially, or as processed foods rather than being used in their natural state.

For instance, cultures of micro-organisms and leeches for medical purposes fall under Class 5 because they are therapeutic uses but not for agricultural or environmental purposes. Similarly, animal dietary supplements and medicated animal feed fall under Class 5 because they contain medicinal properties and are not simple pet food or raw feed materials.

Other Exclusions

The same exclusion under Class 31 extends to processed and semi-worked materials. Example: Semi-worked woods fall within Class 19 due to treatment on them for construction or manufacturing purposes. Artificial fishing bait, on the other hand, used for recreational or professional purposes of fishing, is classified under Class 28.

Rice also falls under Class 30 because it is a staple food product, and not an unprocessed crop. Tobacco also cannot fit under Class 31 because it forms Class 34 for smoking.
