What is Trademark Class 16?

Trademark Class 16 covers paper, cardboard, and printed products, as well as stationery and office supplies. This class is essential for businesses involved in the production and distribution of printed and paper-based goods.

Examples include notebook manufacturers, book publishers, and stationery producers. Class 16 ensures proper trademark classification for paper products and related goods.

What are key features of Class 16?

Key features include products made from paper or cardboard, as well as writing instruments and other office supplies.

Class 16 for trademarks: a brief description

Class 16 encompasses a variety of paper and stationery products, including printed publications and office supplies. This class serves businesses producing educational, promotional, and decorative paper goods.

Products in this class are widely used in offices, schools, and homes.

Practical examples of Class 16

Examples include manufacturers of calendars, producers of wrapping paper, and suppliers of office stationery.

What Does Class 16 Include?

Class 16 principally includes paper goods, office stationery and stationery, artists' materials, and instructional and teaching materials in writing, printing, painting, and packaging. This class includes some disposable paper products and some ornamental articles made of paper or cardboard.

Key Products in Class 16

This class encompasses all those arms used for manipulation in paper, be it a paper knife or paper cutter. It also encompasses cases, covers, and accessories for holding or securing documents, including document files, money clips, cheque book holders, paper clips, passport holders, and scrapbooks. These items will be essential in managing and organizing paperwork efficiently.

Also comprised in Class 16 are office machines, such as typewriters, duplicators, franking machines for office use, and pencil sharpeners, among others. Such machines are found in administrative and creative work settings. Products connected with painting, for artists, as well as for interior and exterior painting, are also comprised in this class. For example, this class includes watercolour saucers, painters' easels, palettes, paint rollers, and trays.

Also comprised in Class 16 are bibs, handkerchiefs and table linen of paper; and a wide range of goods made of paper and cardboard not otherwise classified by function, such as paper bags, envelopes, and containers, and also artistic and decorative items, such as paper statues and figurines, papier-mâché sculptures, lithographs, paintings, and watercolours, framed or unframed. Class 16 is a huge category that includes everything from stationery to art supplies, accurately classifying products related to office work, packaging, and creative expression.

Trademark Class 16 does not include

While Class 16 is largely paper products, office supplies, and artistic materials, some related items are excluded outright and relegated to other classes of trademarks. Paints, as well as a variety of other artists' materials, teaching materials, and those paper products designated by function, rather than the material, themselves, are good examples.

For example, paints fall under Class 2, but not Class 16, because they represent coating and finishing apparatus in their own right, rather than stationery or paper products. Similarly, manual tools for artists, like spatulas and sculptors' chisels, fall into Class 8, since they represent hand tools in their own right, not painting or drawing instruments specifically.

Additional Exclusions

Certain teaching apparatuses and educational equipment are also excluded from Class 16. Included are audiovisual teaching apparatuses in Class 9, as they are either electronic or medical training apparatus, and resuscitation mannequins. Toy models for use in education or play go to Class 28, rather than Class 16.

Paper and cardboard products are also classified according to their functional use rather than according to their material composition, in a number of cases. For example, photographic paper is classified under Class 1, abrasive paper under Class 3, and paper blinds under Class 20. Similarly, paper cups and plates that are to be used and discarded as tableware are classified under Class 21, while bed linen made of paper is classified under Class 24. Also excluded are paper clothing (Class 25) and cigarette paper (Class 34), for example, because such goods clearly do not function either as basic stationery or as packaging material. These exclusions are important in ensuring that businesses register their products in the right class for proper classification and legal protection.
